Refunds and Cancellations Policy

This Refunds and Cancellations Policy applies to Services offered under the KadakHost brand.
KadakHost is a brand owned and operated by VRSK Enterprises, India (“KadakHost”, “VRSK Enterprises”, “we”, “us” or “our”).
This Policy should be read together with the KadakHost Terms and Conditions and any applicable quotation, order, service agreement, statement of work or product-specific terms.
By purchasing or using a KadakHost Service, you agree to this Policy.
1. General Refund Policy
Payments made to KadakHost are generally non-refundable once the applicable Service has been successfully provisioned, activated, delivered or work has commenced, except where applicable law requires a remedy or these policies or an accepted written agreement provide otherwise.
The no-refund provisions concern change-of-mind cancellations and Services correctly provided as agreed. They do not exclude remedies required by applicable consumer law for deficient Services, Services materially different from what was advertised or agreed, non-delivery, or delay where the law requires a refund. Statutory rights take priority over every exclusion in this Policy, including exclusions for work commenced, renewals, third-party costs, payment fees and partial periods.
Examples may include situations where:
- KadakHost is unable to provision the ordered Service;
- required infrastructure is unavailable and no reasonable alternative can be provided;
- KadakHost accepts payment but is technically unable to activate the purchased Service;
- a Service is permanently discontinued before it can be delivered;
- KadakHost determines that an order cannot be fulfilled after payment has been received; or
- a refund is otherwise expressly agreed by KadakHost in writing.
A temporary interruption, support issue, performance concern or short-term outage does not automatically qualify for a refund.
2. No Partial Refunds
Unless otherwise expressly stated in a written agreement, quotation or service-specific terms, KadakHost does not provide prorated or partial refunds for unused portions of an active billing period.
This applies where a Customer:
- cancels before the end of the billing period;
- stops using the Service;
- deletes a server or application;
- migrates away from KadakHost;
- uses only part of the allocated resources;
- no longer requires the Service; or
- chooses not to continue using a Service that remains available.
The Customer may continue using the Service until the end of the already-paid billing period unless the Service is terminated earlier for another reason under the Terms and Conditions.
The no-partial-refund rule does not override mandatory remedies or the Terms and Conditions provision for discontinuation by KadakHost for commercial reasons unrelated to Customer misconduct. Any refund due for an unprovided part of a prepaid Service is assessed under those provisions.
3. Cancellation of Recurring Services
Customers may cancel recurring Services at any time by emailing support@kadakhost.com or using another method designated by KadakHost.
Unless otherwise stated, cancellation will become effective at the end of the current paid billing period.
Cancellation prevents the Service from renewing for the next billing period.
For example, if a Customer purchases a monthly Service and cancels halfway through the month, the Service will normally remain active until the end of that monthly billing period and will not renew for the following month.
No refund will be issued for the remaining portion of the current billing period.
4. Cancellation Requests
A Service will be considered cancelled only after the cancellation request has been successfully submitted through an approved KadakHost cancellation method.
Merely:
- stopping use of the Service;
- deleting files;
- shutting down a server;
- deleting an application;
- removing DNS records;
- stopping a workload; or
- failing to log into the Service
does not constitute cancellation.
Customers remain responsible for ensuring that cancellation has been properly submitted.
5. Automatic Renewals
Where automatic renewal or recurring payment functionality is enabled, recurring Services may renew automatically according to the selected billing cycle.
Customers who do not wish to renew a Service must cancel it before the applicable renewal date.
KadakHost is not required to refund a valid renewal payment merely because the Customer forgot to cancel before the renewal date.
Where required by applicable law or specifically agreed in writing, different terms may apply.
6. Failed or Unsuccessful Provisioning
Payment confirmation does not necessarily mean that a Service has been successfully provisioned.
Some Services require infrastructure, software, capacity or other resources to be available after payment is received.
If KadakHost receives payment but cannot successfully provide the purchased Service, KadakHost may:
- retry provisioning;
- offer an equivalent Service;
- offer a different configuration;
- offer a different location;
- offer account credit with the Customer’s agreement; or
- refund the amount paid for the unfulfilled Service.
An alternative configuration, location or account credit requires the Customer’s agreement. Where no suitable alternative is agreed, KadakHost will refund the amount paid for the Service that could not be delivered, subject to any additional remedy required by law.
7. Managed App Hosting and AI Hosting
Managed App Hosting and AI Hosting subscriptions may be cancelled at any time.
Cancellation will normally become effective at the end of the current paid billing period.
No prorated refund is ordinarily provided for change-of-mind cancellation during a correctly supplied billing period, except where applicable law, this Policy or an accepted written agreement requires otherwise.
Customers should export or download any required data before the cancellation becomes effective.
Once the Service terminates, associated hosted data may be deleted according to the KadakHost Terms and Conditions and applicable service-retention practices.
These rules cover Static Site Hosting, Web App Hosting, standalone Managed Databases and recurring Custom Application Hosting. An included Web App database is part of the same plan; not using it does not reduce the price. Cancelling an independent database plan does not automatically cancel an associated application plan, or vice versa. Customers should identify all Services they wish to cancel and export required data.
AI Hosting follows the recurring-service cancellation and non-delivery rules in this Policy. Model, embedding and other API charges paid directly to external providers are separate transactions; requests concerning those charges go to the provider. This does not limit any remedy for KadakHost’s own failure to supply the agreed hosting, resources or backups. Before termination, export required workspace data and revoke credentials that are no longer needed.
7.1 Custom Hosting, HA and DR
Custom hosting, HA and DR quotations distinguish one-time design, setup or migration work from recurring infrastructure, management and testing. Correctly completed agreed work and resources already supplied are treated according to the quotation and this Policy. Unperformed work or undelivered Services remain subject to applicable refund rights; a recovery commitment that was not delivered is not automatically treated as fulfilled merely because a plan or document was prepared.
The quote identifies cancellation effects on replicas, standby resources, backup retention and recovery coverage. Cancellation of protection may remove recovery capacity. Any agreed handover or export scope and mandatory remedies remain applicable.
8. Consulting and Professional Services
Consulting, setup, migration, implementation, configuration and other professional services may involve time and work performed specifically for a Customer.
Amounts relating to consulting or professional work already performed are non-refundable.
Where the Customer cancels an engagement before work is completed, KadakHost may charge for:
- work already completed;
- time already spent;
- resources already committed;
- third-party charges already incurred; and
- other non-recoverable costs associated with the engagement.
Where KadakHost is unable to perform an agreed consulting service, any amount attributable to work that cannot be provided may be refunded.
The exact terms of a consulting engagement may also be specified in a quotation, statement of work or written agreement.
8.1 AI Consulting Builds, Advisory and Care
Standard builds use a 50% reservation payment and 50% following successful acceptance testing, before production activation and final handover, unless the accepted statement of work expressly states otherwise. Advisory services are payable upfront. Neither advance payment nor silence establishes acceptance. Material failures against agreed acceptance criteria must be addressed before sign-off. In-scope defect fixes reported within the included period remain included without consuming paid care hours; this does not restrict mandatory remedies for deficient services or non-delivery.
For Customer cancellation, the settlement identifies completed work and authorised non-recoverable commitments under the accepted scope. An advance is not automatically forfeited solely because work began. Any balance exceeding properly chargeable work and commitments is returned; statutory rights remain controlling. These specific settlement terms take priority over general non-refundable setup or consulting language elsewhere in this Policy.
Automation Care is a separate recurring subscription, cancellable under the recurring-service rules. Unused monthly hours expire and do not roll over or ordinarily create a change-of-mind refund. No unapproved excess-hour charge applies. Care normally begins after the included defect-fix period unless the Customer requests an earlier start. Ending care does not itself cancel a separate hosting subscription or remove continuing rights to paid-for project deliverables; hosting cancellation does not automatically cancel care either. Customers should specify which Services they wish to cancel and arrange any required export and credential revocation.
AI, OCR, messaging and platform charges paid directly to external providers are separate transactions. Those providers handle their own billing remedies; KadakHost remains responsible for the work and Services it supplies.
9. Setup and One-Time Charges
Setup fees, implementation fees, migration charges, installation charges and other one-time fees are generally non-refundable once the associated work has commenced.
If KadakHost is unable to begin or provide the applicable work, the relevant fee may be refunded.
10. Third-Party Costs
Some KadakHost Services may involve third-party infrastructure, software, licences, registrations or other external costs.
Where KadakHost has already incurred a non-refundable third-party charge specifically for the Customer, that amount may not be refundable even if another part of the Service is cancelled.
Where applicable, such conditions may also be identified in the relevant quotation, order or agreement.
11. Service Credits
Service credits are different from cash refunds.
Where KadakHost offers a Service Level Agreement or otherwise agrees to provide service credits, such credits may be applied to future KadakHost Services according to the applicable terms.
Service credits do not automatically create an entitlement to a cash refund.
12. Service Issues and Support Requests
Customers should contact KadakHost support if they experience a technical issue.
KadakHost must normally be given a reasonable opportunity to investigate and attempt to resolve the issue before the Customer requests a refund on the basis that the Service could not be provided.
A technical issue does not automatically mean that the Service is considered undelivered.
Where the Service remains usable or the issue can reasonably be corrected, KadakHost may resolve the issue instead of issuing a refund.
13. Customer Configuration and Application Issues
Refunds will not normally be provided for issues caused by:
- Customer configuration;
- Customer-installed software;
- unsupported software;
- custom code;
- third-party applications;
- plugins;
- extensions;
- scripts;
- customer firewall rules;
- incorrect DNS configuration;
- lost credentials;
- unsupported operating-system changes;
- excessive resource usage; or
- other actions performed by or on behalf of the Customer.
KadakHost may provide assistance where included in the applicable Service, but such issues do not by themselves create refund eligibility.
14. Suspension for Non-Payment
Services may be suspended if payment is not received by the applicable due date.
Suspension for non-payment does not entitle the Customer to a refund for the period during which the Service remains suspended.
If the Service is terminated for continued non-payment, previously paid amounts remain non-refundable.
15. Suspension or Termination for Policy Violations
No refund will normally be issued where a Service is suspended or terminated because the Customer:
- violates the KadakHost Terms and Conditions;
- uses the Service for unlawful activity;
- engages in abuse;
- causes security threats;
- engages in fraudulent activity;
- causes harm to KadakHost or third parties; or
- otherwise materially violates applicable service rules.
KadakHost may, where appropriate and legally permitted, consider refunding unused amounts at its discretion, but is not obligated to do so.
16. Customer-Initiated Migration
If a Customer chooses to migrate a Service to another provider, this does not create a right to a refund.
The Customer may continue using the KadakHost Service until the end of the current paid billing period after submitting cancellation.
Migration assistance may be provided where included in the applicable Service or separately purchased.
17. Data Following Cancellation
Customers are responsible for downloading or exporting required data before cancellation becomes effective.
After the Service terminates, KadakHost may delete associated:
- server data;
- application data;
- databases;
- files;
- containers;
- volumes;
- snapshots;
- backups;
- logs; and
- configuration.
Cancellation does not require KadakHost to retain customer data indefinitely.
18. Refund Processing
Approved refunds will normally be returned using the original payment method where technically and commercially possible.
Where this is not possible, KadakHost may use another reasonable refund mechanism.
The time taken for the refunded amount to appear in the Customer’s account may depend on:
- the payment gateway;
- bank;
- card issuer;
- payment network; or
- other financial institution.
KadakHost is not responsible for processing delays occurring after the refund has been successfully initiated through the applicable payment system.
Accepted refunds are initiated within a reasonable period and within any period required by applicable law or binding payment-system requirements. KadakHost will communicate the refund status or reference when available; this does not guarantee when an independent bank will post the credit. A payment-provider delay does not remove any legal obligation that remains ours.
19. Payment Gateway Charges
Where permitted by applicable law, non-refundable payment processing or transaction fees charged to KadakHost by third-party payment providers may be excluded from the refunded amount where such charges cannot be recovered.
Any such deduction will be communicated where applicable.
20. Duplicate Payments
If the Customer is accidentally charged more than once for the same transaction, the duplicate payment will be refunded after verification.
The Customer should contact KadakHost support with the relevant payment or transaction details.
21. Incorrect Charges
If a Customer believes they have been charged incorrectly, they should contact KadakHost support promptly.
KadakHost will review the relevant transaction and account records.
Where an incorrect charge is confirmed, KadakHost will correct the billing issue and refund any amount incorrectly collected.
22. Chargebacks and Payment Disputes
Customers should contact KadakHost before initiating a payment dispute or chargeback so that billing concerns can be investigated.
A chargeback filed for a valid charge may result in:
- account review;
- temporary suspension;
- restriction of Services; or
- termination in cases of fraudulent or abusive payment activity.
Nothing in this provision limits rights that the Customer may have under applicable law or the rules of their payment provider.
23. Refund Requests
Refund requests must be submitted through the support or billing channels published on the KadakHost website.
The request should include sufficient information to identify:
- the Customer;
- relevant order;
- Service;
- payment; and
- reason for the request.
KadakHost may request additional information where reasonably necessary to investigate the request.
24. Exceptional Refunds
KadakHost may, at its sole discretion, provide a refund, credit or other accommodation in exceptional circumstances even where a refund is not required by this Policy.
Doing so in one case does not create an obligation to provide the same accommodation in another case.
25. Written Agreements and Special Terms
A written quotation, service agreement, statement of work or other written agreement may specify different refund or cancellation terms for a particular Customer or Service.
Where such terms expressly conflict with this Policy, the specific written agreement will apply to that Customer or Service.
This includes agreements that expressly provide for:
- prorated refunds;
- minimum commitments;
- fixed contract periods;
- notice periods;
- termination charges;
- prepaid commitments; or
- custom refund arrangements.
26. Changes to This Policy
KadakHost may update this Refunds and Cancellations Policy from time to time to reflect changes in Services, billing practices, payment methods, legal requirements or business operations.
The latest version will be published on the KadakHost website.
Material changes affecting existing Services may be communicated where appropriate.
27. Governing Terms
This Policy forms part of the KadakHost Terms and Conditions.
In the event of a conflict between this Policy and a specific written service agreement, the specific written agreement will prevail for that Service.
